This website privacy policy (the “Privacy Policy”) informs visitors to www.wacker.com (the “Website”) about how Wacker Chemie AG, in its capacity as controller as defined by Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – “GDPR”), collects, processes and uses the personal data and other information of visitors to the Website.

What personal data about you do we process for what purposes? What is the legal basis?

Usage Data

When you visit the Website, we collect the following information: e.g. web browser and operating system used, referring page, webpages accessed, downloaded files, plays of videos/audio, clicks on individual links, search words and phrases, length of visit, IP address, date and time of request.

Usage data are used to enable your access to the Website, to maintain and restore the security of the Website, and to detect malfunctions and errors in electronic communications.

All this is necessary, for technical reasons, for us to provide the Website to you. Legal basis: to the extent that personal data are affected, the relevant legal basis is point (f) of Article 6(1) GDPR. Processing of Personal Data

We process personal data only if you provide such data to us of your own accord (e.g. by registering, making a contact request, filling in forms or sending emails). In the context of business relationships, we process personal data required for said relationships. We will forward your personal data to third parties only when necessary for the provision of the service requested by you, or if you have given us your consent for such forwarding.

The legal basis for processing data is our legitimate interest pursuant to point (f) of Article 6(1) GDPR in responding to your needs. If your contacting us is aimed at entering into a contract or if personal data are processed as part of a business relationship, the additional legal basis for the processing is point (b) of Article 6(1) GDPR.

Registration on the Website

You can register as a user on the Website. Registration is required for the use of additional services. As part of that registration, we collect and process additional data as can be seen from the respective input forms. We rely on statutory permission (point (b) of Article 6(1) of Regulation (EU) 2016/679) as the legal basis for processing personal data to provide personalized services. We store such data of registered users until the user account is deleted.

If you use our personalized online services, you must enter certain personal data that we process and store as a basis for aligning our service portfolio with your needs. Determination of Location

In order to automatically present the product portfolio valid for your country when you load our webpages, it is necessary to process your IP address. Here we rely on points (f) and (c) of Article 6(1) GDPR as the legal basis for processing. When determining your location, we do not store your IP address. Advertising Relating to Your Personal Interests

You can give us your consent for WACKER to email you marketing information based on your personal interests as regards WACKER’s products and services.

My consent means that the personal data you provided and any further information generated about your user behavior (e.g. data collected during registration on the WACKER website; articles, products and content viewed during your visits to the WACKER website, and documents downloaded in marketing emails; date and time of retrieval; confirmations to show when emails and newsletters were received and read) can be processed by WACKER in line with point (a) of Art. 6(1) GDPR for the purpose of compiling a personal user profile until you withdraw your consent. Web Analytics

For the purposes of advertising, market research and customized design of the Website (and the newsletter, if applicable), we use web analytics software and/or JavaScript to collect and process usage data on your visit to the Website and on your use of links in the newsletter, if available.   • Matomo (Piwik)
    On the websites of the online annual and sustainability reports, the open-source web analytics tool Matomo (formerly Piwik) is used for the statistical evaluation of visitor interactions. The data collected by Matomo are stored in anonymized form to improve our web presence. In addition, cookies are used that enable the creation of pseudonymized usage profiles. The data collected with Matomo will not be used without your consent to personally identify you or to reverse the pseudonymization. By using the Website, you agree to Matomo processing the data collected about you in the manner described above, and for the aforementioned purposes.
  • Google Ads
    The Website uses the Google Ads online advertising tool and its conversion tracking feature. When a user clicks an ad placed by Google, a conversion tracking cookie is set. These cookies expire after 30 days, and involve only non-identifiable information. If a user visits certain webpages of the Website and the cookie is still valid, WACKER and Google can detect that the user clicked the ad and was redirected to the ad webpage. Each Google Ads customer is assigned a unique cookie. Cookies therefore cannot be tracked by means of Ads customers’ websites. The information collected through the use of conversion tracking cookies provides conversion statistics for Ads customers who have chosen to use conversion tracking. These customers obtain statistics showing the total number of users who clicked their ad and were redirected from the ad to a webpage that has a conversion tracking tag. All the information collected is non-identifiable, meaning that no personal data about users are collected. Users who prefer to disable the conversion tracking feature can do so easily in their browser settings. These users are then excluded from the conversion tracking statistics.     The information collected by means of the conversion tracking cookie helps us generate statistics about our conversion rate. That means we learn how many users are coming from a Google ad and buying a product through the Website within 30 days.

Forwarding to Third Parties

We forward your data within the WACKER Group and to third parties, especially our distribution partners, solely for the performance of contracts or for pre-contractual steps, or when it is in your interests for us to do so.

Your data will also be partly processed in countries outside the European Economic Area (“EEA”), where the levels of data protection might generally be lower than in Europe. Where that is the case, WACKER will take measures to ensure an appropriate level of data protection by other means.

reCAPTCHA

The IP address transmitted by your browser as part of reCAPTCHA will not be merged with other data held by Google unless you are signed into your Google Account when you use the reCAPTCHA plug-in. If you want to stop such transmission and storage by Google of data about you and your behavior on the Website, you must sign out of Google – before you visit the Website or use the reCAPTCHA plug-in.

Google Maps

By registering with WACKER, you create an account in the job and application portal. By doing so, you provide the company with your personal data for the purpose of finding a job and express your interest in working for WACKER. Your data will be stored and processed in the systems of our software partner, SAP SuccessFactors.

In addition to the general information, this privacy policy also includes additional information that relate exclusively to certain countries.

1. Which WACKER company has access to your personal data?

The job and application portal is provided and operated by WACKER Chemie AG, Gisela-Stein-Straße 1, 81671 Munich, Germany ("WACKER AG "). WACKER AG is therefore the global controller for data processing in accordance with this privacy policy.

The job and application portal offers you various options and choices that affect how we share your data within WACKER. You can adjust the respective options at any time in your own account under "Settings":

  • Option 1: With checking the box “I would also like to be considered for other positions” you create an account and choose to be considered for open positions worldwide.
  • Option 2: With checking the box “I only want to be considered for jobs that I have applied for” you create an account and only apply for positions of your choice.

If you have decided for

  • Option 1: WACKER AG makes your personal data available to all WACKER Group companies worldwide that may offer positions matching your profile;
  • Option 2: Your personal data will only be made accessible by WACKER AG to the WACKER Group company that advertised the position in question and to the respective (technical and personnel) managers and recruiters responsible for the hiring decision.

2. Which categories of data are processed?

WACKER processes the following personal data about you:

  • Information that you actively provide to us when you set up your account on the WACKER job and application portal, including your full name, email address, your country/region, phone number, login details, contact information, resume, additional documents, your professional experience, qualifications and skills ("profile data ");
  • Publicly accessible professional data about you, such as data published in company and employment-oriented social networks or websites, such as LinkedIn ("professional and education-related social network data "). Professional and educational social network data is part of your profile and therefore also part of the profile data.
    To clarify: We do not collect and process data from social networks or websites that do not have a company or employment-oriented context.
  • Information that you actively provide to us in the further course of the application process for a specific vacancy and related information that we have collected from you in the course of your interviews and assessments that you have provided to us during the application process ("application data ").
  • Information contained in your uploaded resume to be matched with job openings ("document matching "), even without registering or logging in, if applicable.
  • ·Information about your interaction with the job and application portal, including your device and user ID, information about your operating system, sub-pages accessed during your visit, the date and time of each visitor request ("usage data ").

We do not ask you to provide us with special categories of personal data (i.e. information about race or ethnicity, political opinions, religious or philosophical beliefs, trade union membership, health or sexual orientation) as part of your application data, unless required by law in individual cases. If you provide us with special categories of personal data, you hereby expressly consent to the processing of this data as described here.

3. For what purposes do we process your data?

WACKER processes profile data, professional and education-related social network data and application data for the following purposes:

  • To process your application;
  • to assess qualifications and personal suitability;
  • to show you other suitable jobs as part of your personal user interface in the job and application portal; and
  • to send you information, documents and invitations in connection with your profile.

WACKER processes application data for the following purposes:

  • to process your application; and
  • to assess qualifications and personal suitability.

WACKER processes the document matching for the following purposes:

  • to enable the job and application portal to make suggestions for suitable jobs and to help you find the open position(s) that best match your skills and talents.

WACKER also processes your data for the following purposes:

  • To provide job and application portal services and functions, which include the following: Creating and managing your online account, updating, securing and troubleshooting, providing support and improving and developing the job and application portal and our application processes and services.
  • To the extent necessary to establish or maintain a legal claim or defense and to prevent fraud or other unlawful activity, including attacks on our information technology systems.

4. How long do we store your data?

The categories of personal data described under point 2 will only be stored for the duration of the application and a reasonable subsequent period permitted or required by local law (taking into account statutory limitation periods under the applicable laws and regulations).

  • Successful application: If you accept a position at WACKER on the basis of your application, your personal data or, if applicable, an excerpt thereof will be included in your personnel file.
  • Rejection for a specific position or unsolicited application: If you have applied for a specific position or submitted an unsolicited application but received a rejection, your data will be stored after completion of the application process in accordance with the regulations of your country and / or state in order to answer questions in connection with your application and your rejection. This is done, for example, to defend against claims in connection with the application or due to WACKER's obligation to store data as required by law. In the event of ongoing legal or disciplinary proceedings, the personal data may be stored until the conclusion of these proceedings and until any appeal periods have expired.     If you do not agree to this or are no longer interested, you can delete your data yourself at any time. If your application is assigned to a talent pool, we will only store your personal data for as long as permitted or required by applicable law. Thereafter, we will remove your data from our systems and records or ensure that the data is properly anonymized and can therefore no longer be used to identify you.

You have the right to assert your data subject rights as described in chapter 6 or in the local supplements. For example, you can request earlier deletion of the data at any time.

5. Who are the recipients of your data?

As described above, you have the choice to decide to which WACKER company your data will be forwarded. In addition, WACKER may engage service providers (so-called data processors) to support us in the processing and use of your data, particularly in the area of IT services.

In particular, if personal data is transferred by WACKER to a recipient outside the European Economic Area (EEA) (e.g. to other WACKER Group companies than the one you have applied to), WACKER will ensure that these transfers do not undermine the level of protection of your personal data. If the country of destination is not covered by an adequacy decision of the European Commission, WACKER will use a transfer tool to ensure an equivalent level of protection for your personal data, such as the standard contractual clauses approved by the European Commission. Processing of Sensitive Personal Information:

According to PRC Personal Information Protection Law (“PIPL”) and other applicable laws and regulations, sensitive personal information is personal data that, if disclosed or used unlawfully, may easily violate the dignity of natural persons and seriously affect personal or material security, including information on biometric characteristics, religious beliefs, special identity, medical health , financial accounts, tracking of individual location, etc., as well as the personal data of minors under the age of 14.

You acknowledge and consent that your sensitive information of your photo (if any) and ID Number will be processed by us for the purpose of interview, background investigation and preparing offer and labor contract and other purposes as described in Chapter 3. In principle, we ask you not to provide us with any other sensitive personal information as part of your application data, unless this is required by law in individual cases. If your other sensitive personal information is processed, we will inform you about the necessity of the processing and the effects on the rights and interests of the individual and, if necessary, obtain your express consent.

Why and how we process your Personal Information

We use your personal information for the purposes as described in chapter 3 of this Privacy Policy.
